Plain English, on purpose. Last updated September 2026. Questions: hello@nomback.com. How we handle personal information is in the privacy policy.
Nomback ("we", "us") is Daniel Lomonaco, doing business as Nomback, a sole proprietorship in Pennsylvania, at [MAILING ADDRESS - PO BOX]. We build ordering and loyalty apps for independent restaurants. The Partner program pays you for introducing us to restaurant owners who want one. By creating a partner account you agree to these terms. You must be 18 or older and live in the United States.
You are not our employee, agent or representative. You choose when, where and whether to pitch. You cover your own costs. You can't sign anything on our behalf, and you can't promise a restaurant anything that isn't on the price sheet in your dashboard.
A referral is a restaurant you send in through your dashboard (or that requests a preview through your personal link) before anyone else sends in the same restaurant. First submission wins. To be accepted it must be a real, currently-open, independently owned restaurant, and the contact you give us must be the owner (or the person who can decide), who has actually agreed to hear from us. We check every one; we can decline any referral, and our decision is final. Chains, franchises, duplicates, closed places, made-up places and contacts who never agreed all get declined.
The amounts shown in your dashboard at the moment a referral is accepted and at the moment it goes live are the amounts that apply to that referral, even if we change the program later. Today that is: an accept payment when we accept the referral (with an extra one-time bonus on your first accepted referral), a launch payment when the restaurant's app is published, a monthly payment for each of the first twelve months the restaurant stays a paying customer, and bonuses when your 3rd, 10th and 25th restaurants launch. Monthly payments stop if the restaurant cancels. We may change the program for future referrals at any time; your dashboard always shows the current plan.
To the payout method in your profile: Cash App, Venmo, Zelle, PayPal or Whop. You're responsible for the handle being right; a payment sent to the handle you gave us counts as paid. Accept and launch payments within 7 days; monthly payments and bonuses on the 1st of the following month. We'll email you to confirm where to send it if we don't have it. Nothing is owed for referrals that were declined, or for referrals that turn out to have been misrepresented. If we've overpaid you by mistake, we'll net it against future payments.
You're responsible for your own taxes. If your earnings in a calendar year reach the IRS reporting threshold ($2,000 for 2026), we'll ask you for a W‑9 and send you a 1099‑NEC. State rules can differ.
Breaking these gets the account closed and any unpaid amounts forfeited.
You can stop any time, just stop. Anything already earned is still paid. We can close accounts that break section 7 or that have been inactive for a year. If we end the program entirely, we pay what's already earned and stop there.
The figures on our site and in your dashboard ($320 per restaurant, the year-one estimates in the calculator) are what the plan pays per restaurant and what the arithmetic produces at a given pace. They are not a promise of income. What you make depends entirely on how many owners you talk to and how many say yes. Don't repeat those numbers to anyone you recruit as though they're guaranteed, and don't invent your own.
What we collect about you and about the restaurant owners you send us, who else touches it, how long we keep it and how to get it deleted are set out in the privacy policy, which is part of this agreement. We don't sell personal information, and an owner's contact details are yours to pass to us and to nobody else.
The program is provided as it is. We don't guarantee the site will always be up, that a referral will be accepted, or that a restaurant will sign or stay. We're not liable for anything you spend chasing referrals, for lost time, or for indirect losses. Whatever we might owe you for a dispute about this agreement is capped at what we've paid you in the twelve months before it came up.
This is the whole agreement between us about the partner program. If a part of it turns out to be unenforceable, the rest still stands. It's governed by the laws of the State of Pennsylvania, USA. We may update these terms; if we do, we'll change the date at the top and note it in your dashboard, and continuing to use the program means you accept the update.
